Development Agreement Summary
Lindell Development Inc. entered into a Development Agreement with the R.M. of Woodlands. This is a summary of the particular issues and responsibilities of the Lot Purchaser. Other specific Building Permit Requirements also apply to the Lot Purchaser.
It is understood and agreed between Lindell Development Inc. and the R.M. of Woodlands hereto that the following restrictions shall apply to within the planned area:
General

No building shall be erected on the lands other than a one dwelling house with an attached garage or detached garage providing for a minimum of two parking spaces within such garage and such dwelling house to be used for single family requirements only. One other outbuilding of no more than 320 square feet, to be used for storage may be erected.

No more than one driveway shall be constructed for each dwelling unit and the driveway shall have no more than one access to and from the abutting street, and such access not to be to and from more than one street within the planned area.

No dwelling shall be erected or stand upon the lands or any part thereof which have floor area exclusive of any open porch, garage of breezeway of less than the following number of square feet:
Bungalow: Minimum area of house only 960 square feet;
Split-Level: Minimum area of house only 1,050 square feet;
Bi-Level: Minimum area of house only 1,050 square feet; and,
Two-Story: Minimum area of house only 1,500 square feet.
For the purpose of this paragraph, 'floor area' shall mean the floor area of the dwelling unit measured within the exterior faces of the exterior walls of the dwelling unit. The floor area in the basement, porches and garage shall not be included in the calculation of the dwelling unit area.

No building or construction of any kind shall commence before a valid Building Permit is issued and is in compliance with the current Zoning and Building By-Laws.

No motor vehicles other than private passenger motor vehicles shall be parked on the lands unless concealed in a wholly enclosed garage.

No excavation shall be made on the lands except for the purpose of building the same or improvement of the gardens or grounds thereof.

No building waste or other material of any kind shall be dumped or stored on the lands except clear earth for the purpose of levelling in connection with the erection of a building thereof or immediate improvement of the grounds.

All lots are to be connected to the water system and wells are not allowed in the development.

All septic tanks are to have a 3/4 horse power pump installed which must be capable of producing a minimum of 19 gpm at 55 feet of head.
Lot Grades

The Developer shall pay the full cost of the installation of all lot grade posts within the planned area. The lot grade posts shall provide the lot grade as per Lot Grade Plan in the specifications and plans prepared by the Engineer as part of the Development Agreement.

The Developer shall be responsible for maintaining each lot grade post in the planned area until such time as the Developer transfers ownership of the lot.

The Developer shall ensure that the Purchaser of any lot within the planned area is aware of all lot grades as per the Lot Grade Plan in the specifications and plans prepared by the Engineer as part of the Development Agreement.
- The lot owner shall be responsible for maintaining the lot grade posts and the lot grade posts shall not be removed until such time as the lot owner has concluded all landscaping after the building thereon has been erected and the R.M. of Woodlands has inspected and approved the landscaping or until the R.M. of Woodlands provides written permission for any lot owner to remove said lot grade posts.
Landscaping
- Each individual Purchaser of any lot in the planned area shall, at their own expense be responsible for placing topsoil and grass seed or sod on his lot within two years of the home, which is located on said lot, being occupied to the original elevations of the finished grade of the development. Should the homeowner not install such top soil and seed or sod within the two year period to the prescribed elevations, then the R.M. of Woodlands has the right to enter the property for the purposes of installing the same and all costs incurred by the R.M. of Woodlands, including the labour costs of the R.M. of Woodlands' employees, shall be paid by the purchaser.
